Utah Prenuptial Agreement

This Prenuptial Agreement (“Agreement”) is made and entered into on this ____ day of ____________, 20__, by and between ____________________ (hereafter “Party One”) and ____________________ (hereafter “Party Two”), collectively referred to as the “Parties,” contemplating marriage under the laws of the State of Utah.

WHEREAS, the Parties wish to establish their respective rights and responsibilities regarding each other’s assets and liabilities that each may bring into the marriage, and any assets or liabilities acquired individually or jointly during the marriage.

NOW, THEREFORE, in consideration of the marriage and mutual covenants contained herein, and intending to be legally bound, the Parties agree as follows:

  1. Disclosure of Financial Information.

    Party One and Party Two have fully disclosed to each other their current financial status, including all assets and liabilities, as set forth in Exhibits A and B attached hereto.

  2. Separate Property.

    Each Party’s separate property, defined as the property acquired before the marriage or acquired by inheritance or gift during the marriage, shall remain the sole property of that Party, subject to any applicable laws of the State of Utah.

  3. Marital Property.

    Marital property, defined as all property acquired by either Party during the marriage, shall be governed by the laws of the State of Utah, unless expressly agreed otherwise herein.

  4. Division of Property upon Dissolution of Marriage.

    In the event of a dissolution of marriage, property shall be divided according to the terms set forth in this Agreement and, where this Agreement is silent, then in accordance with applicable Utah law.

  5. Modification and Revocation.

    This Agreement may only be amended, modified, or revoked by a written document signed by both Parties and notarized, in accordance with Utah law.

  6. Governing Law.

    This Agreement shall be governed by, and construed in accordance with, the laws of the State of Utah, without regard to its conflict of laws principles.

  7. Entire Agreement.

    This Agreement constitutes the entire agreement between the Parties pertaining to the subject matter hereof and supersedes all prior agreements, whether oral or written.
